Welcome to SMSWay.lk. These Terms and Conditions govern your use of our SMS Gateway Services. By accessing and using our Services, you agree to comply with these terms. Please read them carefully before proceeding with any transactions.

Use of the Service

a. You must be at least 18 years old to use our Services.

b. You are responsible for maintaining the confidentiality of your account information, including your username and password.

c. You agree to provide accurate and up-to-date information during the registration and checkout process.

d. You may not use our Services for any unlawful or unauthorized purposes, including transmitting unethical, illegal, or obscene content.

Service Information and Pricing

a. We strive to provide accurate descriptions, pricing, and information about our Services. However, we do not guarantee the accuracy or completeness of such information.

b. Prices are subject to change without notice. Promotions or discounts are valid for a limited time and may be subject to additional terms and conditions.

c. Changing plans will carry forward existing balances but may adjust the cost per SMS.

Orders and Payments

a. By placing an order for our Services, you are making an offer to purchase the selected Service package.

b. We reserve the right to refuse or cancel any order for reasons such as service availability, errors in pricing or product information, or suspected fraudulent activity.

c. You agree to provide valid and up-to-date payment information and authorize us to charge the total order amount, including applicable taxes and fees, to your chosen payment method.

d. All credit card transactions will be processed securely through a trusted third-party payment processor. We do not store your full payment details.

Duration of Agreement and Termination

a. This Agreement commences on the date of subscription and remains in effect until terminated by either party.

b. Either party may terminate this Agreement with one month’s written notice. However, termination does not absolve the Customer from any outstanding payments due to SMSWay.lk.

c. We reserve the right to terminate this Agreement immediately without reason.

Shipping and Delivery of SMS Messages

a. We will make reasonable efforts to ensure timely delivery of SMS messages to the intended recipients. However, delivery times provided are estimates and may vary based on the Receiving Party’s carrier or network conditions.

Returns, Refunds, and Credits

a. SMSWay.lk does not offer refunds. Any remaining balance in the Customer’s account can only be used for sending SMS messages.

b. Customers are not entitled to credits for breaches of these terms or for service downtime caused by factors beyond our control.

Intellectual Property

a. All content and materials on our website and platform, including but not limited to text, images, logos, and graphics, are protected by intellectual property rights and are the property of SMSWay.lk or its licensors.

b. You may not use, reproduce, distribute, or modify any content from our website without our prior written consent.

Limitation of Liability

a. In no event shall SMSWay.lk, its directors, employees, or affiliates be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of our Services.

b. We make no warranties or representations, express or implied, regarding the quality, accuracy, or suitability of the Services offered on our platform.

Amendments and Termination of Terms

We reserve the right to modify, update, or terminate these Terms and Conditions at any time without prior notice. It is your responsibility to review these terms periodically for any changes.
